TERMS OF SERVICE

SIA EGR, registration nr. 40203553948, Rasas iela 30–13, Rīga, LV-1057, hereinafter referred to as the online store, provides access to the content available on the website and offers goods/services in accordance with the Terms of Use outlined below.

  1. General Terms

If a consumer purchases goods/services through the website, such mutual agreement is considered a Distance Contract and is subject to the laws of the Republic of Latvia, which regulate distance contracts including, but not limited to, the Consumer Rights Protection Law of the Republic of Latvia, the Cabinet of Ministers Regulations "Distance Contract Regulations," etc.

  1. Making a Purchase

The prices and specifications of products sold in the online store are listed alongside the products.

To place an order, add desired products to your shopping cart. Fill in all necessary fields and choose the most suitable delivery method. The total cost of the order with delivery will then be displayed on the screen. Make the payment to complete the purchase.

  1. Payment Terms

The currency for payments on the website is euro. Purchases can be paid for by selecting the following payment methods provided by the payment platform makecommerce.lv, Maksekeskus AS:

  • Latvijas bank transfers: Swedbank, SEB, Citadele un Luminor
  • Igaunijas bank transfers: Swedbank, SEB, Luminor
  • Lithuanian bank transfers: Swedbank, SEB un Luminor
  • Visa/Mastercard card payments

 

NB! When using the bank transfer payment method, confirm the order and click the "Return to Merchant" button.

Personal data required for payment is transferred to the licensed payment institution Maksekeskus AS.

The contract comes into force upon successful payment to the online store's bank account. If, for any reason, it is not possible to fulfill the order, the Buyer will be informed, and the paid amount will be refunded as soon as possible, but no later than within 14 days from receiving the notification.

  1. Delivery Terms

The goods are delivered to the following countries: Latvia, Estonia, Lithuania. The purchased items are delivered using: Omniva, DPD percel machines and courier. All fees and taxes required to receive the shipment at the delivery destination are to be covered by the Buyer. Delivery costs are shown before order confirmation. The purchased items are delivered to the address provided by the Buyer within 2 -5 working days. In exceptional cases, we reserve the right to send the goods within 45 calendar days, informing the customer accordingly.

  1. Right of Withdrawal

The Buyer has the right to withdraw from the purchase within 14 calendar days from the receipt of the Goods. The right of withdrawal does not apply if the Buyer is a legal entity.

To exercise the 14-day right of withdrawal, the goods may only be used for their intended purpose, and the consumer is responsible for maintaining the quality and safety of the goods during the withdrawal period. If the goods are used improperly or damaged during use, if the original packaging of the goods is lost, or if the packaging is significantly damaged, the online store has the right to reduce the refunded amount according to the decrease in the value of the goods.

To exercise the right of withdrawal, you must submit a withdrawal form, which can be found here: https://one-game.eu/pages/return, by sending it to the email address onegameegr@gmail.com within 14 days after receiving the goods.

It is the Buyer's duty to return the Goods to the Seller without delay, but no later than 14 days after sending the withdrawal form to the online store. Upon receipt of the returned goods, the online store will immediately, but no later than 14 days, refund all payments received from the Buyer based on the Distance Contract.

The Seller has the right to withhold payment until the Goods are received from the Buyer or until proof of return of the Goods is provided. If the Buyer has chosen a shipping method other than the cheapest one offered by the online store, the online store is not obliged to compensate for the additional shipping costs.

The online store is not responsible for delays in fulfilling obligations or non-performance thereof, or any other non-performance arising from circumstances and obstacles beyond the reasonable control of the online store.

The online store reserves the right to refuse to sell goods and request their return from the Buyer if the price indicated on the website is significantly lower than its market price due to an error.

  1. Consumer Rights Regarding Non-Conforming Goods

The online store is responsible to the Buyer for defects in or non-conformity of the goods sold within 6 months from the delivery date to the customer, or from the delivery date, if such assumption is not contrary to the nature or defect of the item. The Buyer must inform the Seller of any non-conformity of the Goods immediately, within 2 months of its discovery, i.e., by submitting a complaint. The Buyer can submit a complaint by contacting the online store, writing to onegameegr@gmail.com.

The online store is not responsible for defects that arise after the delivery of the goods to the Buyer. If the purchased goods have defects for which the Seller is responsible, the Buyer has the right to request the removal of defects or exchange for new goods free of charge.

If it is not possible to repair or replace the goods, the Seller refunds all payments received from the Buyer under the Distance Contract. The Seller provides a written response to the consumer's complaint within 15 days.

  1. Processing of Buyer's Personal Data

The online store processes only those personal data entered by the buyer when ordering goods, such as name, surname, email, etc.

The online store transfers personal data to the transport service provider(s) to ensure the delivery of goods.

If you have clearly agreed to receive our marketing communications, including newsletters, we may occasionally contact you by sending information about our services and the latest offers. For this purpose, we may process your email address provided when subscribing to marketing communications. The Buyer has the option to opt-out of marketing communications by notifying us, writing to onegameegr@gmail.com.

  1. Dispute Resolution Procedure

In matters not covered by these terms and conditions, the Buyer and the Seller undertake to comply with the laws of the Republic of Latvia.

The Parties resolve all disputes arising between the Seller and the Buyer through mutual negotiations or correspondence. If the dispute cannot be resolved through negotiations or correspondence, the Parties resolve the dispute in the courts of the Republic of Latvia, in accordance with the laws of the Republic of Latvia. Disputes between the Buyer (consumer) and the Seller may be referred to the Consumer Rights Protection Center or the courts of the Republic of Latvia.

The Buyer also has the right to seek resolution of disputes through the European Union's dispute resolution bodies.
